Fan sues NHL team for sending him too many texts

5/31/2012

Calling all Pittsburgh Penguins fans (but not too frequently): A man who signed up to get text alerts from the NHL team is suing it for sending him more than the three texts per week it specified. The plaintiff says he got at least five texts the first week he'd subscribed, followed by four the next. The extra texts caused him "actual harm" because he was "subjected to the aggravation that necessarily accompanies the invasion of privacy caused by unsolicited text message calls" and may have to pay texting fees. He wants an injunction preventing the team from exceeding three texts per week, as well as unspecified damages. To which we say, here's 60 cents and a lesson on "unsubscribing."
