Nestle trademarks Kit Kat candy-bar shape
1/3/2013Proving that you can pretty much trademark anything, Nestle was recently given the green light to trademark the four-finger shape of its beloved Kit Kat chocolate candy. (Give us a break!) Nestle had fought a long legal battle with bitter choco rival Cadbury over the iconic shape, successfully trademarking it in 2006. Cadbury won an appeal, arguing that a shape is a generic thing that can’t be owned, because, duh, it's a shape. That appeal was recently overturned, giving Nestle its trademark back. If you’re scoring at home, it’s 1-1 in legal battles between the rivals; Cadbury won an earlier ruling that protects its purple packaging. [Source]
